The analysis of the subsoil licensing situation
Pay-based system of subsoil use in Russia established at the time of adopting RF law «On subsoil» is based on the system of subsoil licensing, which in its turn determines the terms of transfer of subsoil plots for use and exercises control over their execution.
The analysis and development of the subsoil licensing system at the territory of Khanty-Mansiysk Autonomous Okrug – Yugra encompasses a number of guidelines, developed at the AI «V.I.Shpilman Research and Analytical Centre for the Rational Use of the Subsoil» (AI «V.I.Shpilman RAC RUS»).
Database maintenance
Created in the Centre databases provide for the informational support which is vital for the functioning of the subsoil plots licensing system at the territory of Khanty-Mansiysk Autonomous Okrug –Yugra. They present practically all databases available in the Information database of the Centre which contain information on the investigation level of the territory, the conducted geological and exploration works, the state of the areas development, the subsoil and natural resources, the ecological state and the industrial infrastructure.
Preparation of plots for licensing realize on the grounds of several regularly update databases, which contain information on the subsoil plots of the unallocated and allocated subsoil funds:
• database of the plots of the allocated subsoil fund;
• license database;
• companies-subsoil users database;
• database of applications for granting the
right for the subsoil use;
• reserve subsoil plots database;
• archived subsoil plots database.
On the basis of the above information as well as attraction different information from Information database of the Centre, long-term and medium-term programs of subsoil plots licensing at the territory of Yugra are developed, the analysis of subsoil use state is carried out, maps for subsoil licensing are prepared.
Bid contests and auctions preparation
During the period from 1993 to 2010 as much as ten bidding rounds on subsoil plots licensing at the Autonomous Okrug territory were held. They resulted in transfer for use of more than 150 subsoil plots. On the whole, the Research and Analytical Centre has prepared a total of about 180 data and information packages.
Elaboration of terms of transfer of subsoil plots for use, acquisition of information and preparation of data packages and licensing monitoring comprise priority trends in the activity of the Research and Analytical Centre.
Elaboration of subsoil licensing programs
One of the basic directions in the activity of the Research and Analytical Centre is elaboration of long-term and medium-term programs of subsoil plots licensing at the territory of the Autonomous Okrug.
By the order of the Autonomous Okrug Government, due to planned changes in the Tax legislation of Russia, which stipulate cancellation of the Reproduction of the Mineral Resources Base rates, in 2001 there was worked out «The concept of development of prospecting and geological-geophysical works at the territory of non-allocated subsoil fund of KhMAO», which was approved by the Resolution of the Government of Khanty-Mansiysk Autonomous Okrug (No. 377-n of July 30, 2001).
Based on the accepted Concept, the Program of subsoil licensing at the territory of Yugra for 2003-2005 was confirmed in May 2003. Execution of this Program resulted in allocation of 110 land plots, which were transferred in use for conducting geological investigations and 12 tracts were allocated for long-term use for the purpose of carrying out geological investigations, exploration works and resources production.
Following the results of the generated programs of licensing 2006, 2007, 2009, 44 subsoil plots are transferred to geological studying in long-term using for 5 years – more than 70 subsoil plots.
Licensing monitoring
One of the components of this direction of works is preparation of annual analytical reviews on the current licensing situation at the territory of KhMAO that contain information on the number of effective licenses, number of subsoil users and major producing companies' structure, quantity of plots transferred for the subsoil use in the accounting year, and also the annual analysis of the licensing program realization.
Control over fulfillment of license agreement terms
Center works in the given direction include:
– Preparation of analytical comments for the authority bodies of Khanty-Mansiysk Autonomous Okrug on the fulfillment of the license agreement terms within the plots of the allocated subsoil fund.
– Preparation of statements for the Interdepartmental commission on considering applications for granting the right of subsoil use at the Yugra territory to take decision on the introduction of any additional terms to the existing license agreements.
Numerous materials compiled in the databases (texts of license agreements and their supplements, annual and quarterly reports of companies- subsoil users, commission's protocols, acts of complex inspections) and the monitoring program of subsoil using developed by request of the Center serve as a basis for the execution of the listed works.
